The Marcellus Shale formation can be found beneath about 60 percent of Pennsylvania’s total land mass, where it is buried to depths of up to 9,000 feet. The most prospective areas for natural gas production are where the shale is present at least 5,000 feet below ground surface.

Michael J. O’Brien successfully defended a Scranton man accused of two (2) counts of aggravated assault and two(2) counts of simple assault relative to an altercation outside of a city bar in 2012. After a three day jury trial and several hours of deliberations, a Lackawanna County jury returned a verdict of not guilty.

April 2014

Erin Brennan successfully defended a local municipality in an action brought against it in the United States District Court for the Middle District of Pennsylvania. The complaint was filed by a local land development company. The complaint alleged that the municipality violated the procedural due process rights of the land development company when it tabled consideration of a land development plan until the developer remedied deficiencies and problems with its past developments within the municipality. The claims against the municipality were for damages in excess of $1.5 million dollars. Summary judgment was entered in favor of the municipality upon the municipality’s motion. The land development company appealed the decision of the District Court and the matter was briefed before the United States Court of Appeals for the Third Circuit. The Third Circuit affirmed the entry of judgment in favor of the municipality.

April 2014

Erin Brennan successfully represented a local municipality in argument before the United States Court of Appeals for the Third Circuit in a case involving an attorney fee award against the municipality. The Third Circuit affirmed the decision of the United States District Court which, upon motion of the municipality, reduced the award of attorney fees and costs from a requested $ 240, 589.93 to $ 66, 938.56.

April 2014

Erin Brennan successfully represented a local municipality in a declaratory judgment action which was brought in the United States District Court for the Middle District of Pennsylvania. The municipality sought a judgment holding that its insurance company had a duty to defend claims for procedural due process violations which were made against the municipality. The insurance company maintained that such claims were excluded from the scope of its policy coverage. Both the municipality and the insurance company filed motions requesting the entry of summary judgment. The District Court ruled in favor of the municipality and ordered the insurance company to pay the costs of defending the claims against the municipality.
